On August 20, 2024, the U.S. Court of Appeals for the Federal Circuit issued a ruling reversing a district court judgment that had dismissed Neonode Smartphone’s patent infringement suit against Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc. In Neonode Smartphone’s infringement suit against Samsung in the U.S. District Court for the Western District of Texas, the district judge had held that the sole independent claim of Neonode Smartphone’s U.S. Patent No. 8,095,879 was indefinite and therefore invalid. The appellate court, however, agreed with Neonode Smartphone that the claim is not indefinite, and adopted essentially the construction proposed by Neonode Smartphone both in district court and on appeal.
